General Terms and Conditions

By submitting an application for a Stall at the HOTA Markets or renewing a current Stall, the Stallholder acknowledges that they have read and understood and agree to comply with the Terms and Conditions, the Privacy Policy and the exclusion of liability and indemnity which are available at www.hotamarkets.com.au.

In this document, “we”, “us” and “our” means Goodwill Projects Pty Ltd ACN 133 432 078. “You” means the stallholder and any of your employees, agents, contractors and invitees.

Booking Enquiries

If you are interested in applying for either a permanent or casual Stall please complete our online application form which is available at www.hotamarkets.com.au or call 0421 196 722 (9am – 5pm, Tuesday to Friday).

In order to receive your requirements accurately and to respond faster we prefer online or email enquiries.

Special Events/Twilight Markets/Market Cancellation

Unless otherwise stated in the Terms and Conditions for a specific event, the following cancellation policy shall apply.

In the event of a full or partial cancellation, the event organiser reserves the right to determine any credit or refund of stall fees, based on the timing of the cancellation and existing creditor obligations. Our priority remains to ensure that all creditors, subcontractors, and suppliers are paid in full at all times.

Permanent Monthly Bookings

Stalls are booked on a permanent basis one month at a time. Permanent fees are paid in advance by the 20th of the current month for the stall bookings of the following month.

Once attendance is confirmed we will provide you with all the relevant information you need.

Upon arrival at the markets you will be met at the Designated Entrance to the Markets and shown to your allocated site by one of our friendly staff.

Casual Bookings

A limited number of casual stall spaces are available each week at HOTA Markets. Casual stalls must be booked and payment must be received by COB on the Wednesday prior to the Sunday that you are attending the market, for us to guarantee a space will be available to you.

Once attendance is confirmed we will provide you with all the relevant information you need.

Upon arrival at the markets you will be met at the Designated Entrance to the Markets and shown to your allocated site by one of our friendly staff.

Wet Weather Policy

Should an event/market be cancelled PRIOR to the official trading hours that are advertised to the public (i.e. 16.00 event start time for the public) formal correspondence via email or SMS will be sent to vendors and a credit may be applicable. A rescheduled date or postponement of the event may be nominated within 48 hours.

Should a market/event be cancelled due to weather during the official trading hours that are advertised to the public (i.e. 16.00 event start time for the public) - no refunds or credits will be applicable. This applies to any cancellation or partial cancellation due to weather or any other causes, including but not limited to force majeure.

Event/Market cancellation is at the sole discretion of the organiser.

Stallholder conduct

Stallholder conduct is an important part of each Market attendance. Conduct specifically refers to professional standards, communication and / or cooperation in the spirit of the markets - including arrival times, vehicle use, language, hygiene, quality standards, illegal sales, drug and alcohol use, correct and honest labelling, presentation, well maintained and safe equipment, courtesy to others including neighbouring stallholders, attendees, safety officials, and staff members, and a zero tolerance to inappropriate, rude, or intimidating behaviour in the form of spoken, physical or deemed similar actions. HOTA Markets reserves the right to evict any stallholder from the market for any reason, before, during, or after the market. This includes the refusal as well as the cancellation of an advance booking or booking schedule.

Please always be conscious of those around you, observe all safety procedures, and please follow all directions upon arrival, during and following each market. Please report any incidents to one of our team members immediately.

Temporary Food Stall License

If you are operating a Food Stall and are unsure about Gold Coast Council requirements for a "Temporary Food Stall License" please contact the Gold Coast Council on 1300 465 326 or visit the Council's website at www.goldcoast.qld.gov.au for further information.

Charity & Community Groups

HOTA Markets support the local community and registered charities. If you qualify as a local community group or a registered charity, we offer heavily discounted Stall fees which are subject to availability.

Information Desk

The Information Desk is located within the market. A first aid kit and the Lost & Found register are also located at the desk.

Stallholder Entry and Exit

Entry times are specific for each Stallholder and will be emailed to each Stallholder in their Bump In information pack. This will be sent the FRIDAY prior to your first market.

Exit time is between 12.00pm and 1.00pm. No packing down during official market hours. All gazebos and gear must be packed down before bringing vehicle on-site.

Please do not move your vehicle until customers have vacated.

Stallholder Parking

No Stallholder is allowed to park within the market area unless prior approval has been given by HOTA Markets Management.

Please be aware that we cannot be made liable for any parking fines.

Public Liability Insurance

Insurance Requirements:

All stallholders must supply their own Public and Product Liability Insurance, to a minimum of $20 Million in Coverage. Details must be supplied in your application or on your online account prior to first day of trade.

Restrictions

Products for sale are limited to:

  • Food & associated products
  • Fruit & vegetables
  • Plants & flowers
  • Fashion & lifestyle products

The sale of some second hand items and counterfeit/illegal goods is not allowed.

You must have your own public and product liability insurance. Please ensure you meet any local, state and federal law requirements.

Important: All food and produce labelling or signs must correctly identify the location and region of origin. This is also an important part of letting your customers know where & what type of seasonal item they are purchasing, whether you are a grower, co-op, wholesaler, distributor, retailer, helping the neighbours, friends or other - this is required. Please ensure this is displayed at all times.

The HOTA Markets reserves the right to refuse entry, remove attendance or permit trade at the markets at any time.

Special Requirements for Food and Beverage Stalls

All Food Stalls need to have a Groundsheet on the floor of their stall to prevent staining. This is a condition of attendance and trading.

All Coffee Stalls need to remove any rubbish and left-over coffee grounds, before leaving the site.

Rubbish

Each stallholder is responsible for removing their own rubbish at the end of each market. Rubbish must not be left on site, nor placed in market or council rubbish bins. A fee of $50 will apply to any rubbish left onsite or in market or council bins.

Bins provided by the market and council are for customer use only. Commercial waste must not be placed in these bins.

Damages

Any damage found to equipment, landscaping, lighting, lessor’s (property owners) and/or market owner’s property will be charged to the individual responsible.

Setting up, Trade, and Packing Down

Please note : All attendees / vendors are required to bump in, set up, stock, trade, pack down and bump out individually. Goodwill Project's staff are not responsible for your stall set up, trade, or pack down however will endeavour to assist wherever possible. Please be conscious our team are very busy and typically will not have time to individually assist vendors.

Power

Stallholders are not, under any circumstances, to approach or touch any power outlets around the market any time. If there are any issues with the power, staff is to be contacted at the Information Desk or via the market mobile immediately.

Exclusion of Liability

To the maximum extent permitted by law, we exclude and are released from any liability to you and your employees, agents, contractors and invitees, whether in contract, tort, statute or any other way, for any personal or financial injury, damage or loss of any kind whatsoever (including, without limitation, any liability for direct, indirect, special or consequential loss or damage), sustained by you, your employees, agents, contractors, invitees and/or any other person, or for any costs, charges or expenses incurred by you, arising from or in connection with your occupancy of the Stall, unless caused by (and only to the extent of) our wilful misconduct, negligence or breach of a statutory duty or warranty.

Indemnity

You are liable for and indemnify us and our directors and officers from and against any claim or action (whether in contract, tort, statute or otherwise, including for negligence), liability, loss, damage, costs (including but not limited to, legal costs on a full indemnity basis), charges and expenses arising from or in connection with your occupancy of the Stall, including, without limitation, loss of or damage to property, or personal injury or death of any person.

This indemnity is independent from your other obligations under these Terms and Conditions and will continue while you are a Stallholder and after you have ceased to be a Stallholder. We may enforce this indemnity before incurring expense.

Joining us for the first time? Please read below to find out everything you need for arrival, set up, and trading.

Arrival Time

Entry times are specific for each Stallholder and will be emailed to each Stallholder in their Bump In information pack. This will be sent the FRIDAY prior to your first market.

On arrival, please say hello to the staff member at the entrance and you will be directed to your site.

Please provide your stall name on arrival.

Please drive safely, turn your hazard lights on, and remain conscious of those around you.

Parking

ABSOLUTELY NO cars are to be left onsite unless prior approval has been given by the Market Manager.

Parking location will be included in your Bump in email, which will be sent to you prior to your first attendance at the markets.

Bump In Information

Bump in information will be sent to you prior to your first attendance at the markets. You will only receive another bump in email should your location in the markets be changed.

Setting up, Trade, and Packing Down

Please note : All attendees / vendors are required to bump in, set up, stock, trade, pack down and bump out individually. Goodwill Project's staff are not responsible for your stall set up, trade, or pack down however will endeavour to assist wherever possible. Please be conscious our team are very busy and typically will not have time to individually assist vendors.

Power

All leads must be tagged and tested. Ensure all leads are run in a safe manner to the distribution board and do not create a trip hazard. Seek staff assistance before plugging in to ANY outlet.

Make sure your generator has RCD switch.

DO NOT LEAVE any petrol containers lying near your area. Government inspectors will be checking each location following the event.

Please bring all necessary extension leads of minimum 25 metre length. Extension leads are not provided by the market operator.

It would be greatly appreciated if all powered stalls could bring additional power leads as a precaution as we are not able to provide redundancy leads.

Wind Weights, Ground Protection and Rubbish

Wind weights are required on all legs of all gazebos. This is a condition of trade.

All stall holders are required to use a canvas groundsheet to prevent any leaks and spills and staining the area. Any stains will need to be repaired at your own cost.

Do not leave your rubbish onsite or in market or council bins. All stall holders are required to remove their own rubbish. Fines up to $100 apply for dumping rubbish onsite or in market or council bins.

Please note spot checks will be carried out from time to time to ensure compliance with these requirements.

Final Things to Remember

Please bring a copy of any required permits and licenses.

Please ensure your vehicle/tent/stall presentation is in perfect condition and most presentable.

Please arrive with a positive and patient attitude to assist in a quick and efficient set up.

Please do not post any signage on existing buildings.

Please do not hang power cords on trees.

Do not leave your rubbish onsite or in market or council bins.
